Claims and Disputes Specialist

The Vancouver Hydro Division is currently recruiting for a Claims and Disputes Specialist to work within a client organization in the delivery of a major infrastructure project in BC. The position is located at our client’s offices and integrated within the project execution team. This is a high profile position with executive level reporting interfaces, and requires exceptional technical and communication skills, together with deep experience in the claims and disputes arena gained on large scale construction and engineering projects.

Job Description

  • Demonstrable track record at a senior level in the claims and disputes arena, preferably with significant international exposure.
  • Highly-developed client facing skills preferably gained within a consulting organization, and in-depth experience of interfacing with Executives, Stakeholders, Management and Contractors in a confident and assured manner.
  • Strong technical understanding of multi-disciplinary engineering projects with complex interfaces and management structures.
  • Thorough understanding of construction and engineering contracts and applicable contract law.
  • Extensive experience in the management of claims and disputes, formulating strategies, advising client on resolution paths, participating in or leading negotiations, advising on general contractual matters.
  • Candidate should be able to work independently, remotely, reporting any issues and trouble shooting them as they arise.
  • Regular travel will be required to construction site.

Responsibilities

  • Collaborate with all disciplines within the client’s organisation (site and management office) as an integral part of the project’s senior management team. Identify potential changes and claims and maintain notices and dvising project team and executives on contractual matters as they arise.
  • Early warning of claims and other issues that may arise.
  • Develop mitigation or management strategies in conjunction with the project team.
  • Draft or support drafting of formal papers in preparation for dispute resolution, including interim resolution forum, arbitration or litigation.
  • Draft counter-claims for the client, maintain rights as required and defend claims from the contractors in conjunction with commercial team.
  • Participate in formal dispute hearings and presentations.
  • Advise on settlement strategies and outcome scenarios.
  • Lead or mentor individuals as may be assigned.
  • Any other duties as may be requested or assigned by client.

Requirements

  • Bachelor’s Degree in Quantity Surveying (or equivalent)
  • Secondary qualification on construction law favoured.
  • Professional accreditation as a Chartered Quantity Surveyor (or equivalent).
  • Professional accreditation as a Chartered Arbitrator (or equivalent) favoured.
  • Minimum 20 years post qualification experience.
  • Minimum 10 years experience in dispute management, dispute avoidance, dispute resolution and claims management.
  • Thorough and demonstrable knowledge of construction contracts and applicable law
  • Proficient in standard methods and established procedures.
  • Experience in design-bid-build and EPC environments.
  • In depth experience in mega infrastructure projects.
  • Experience gained on international projects favoured.
  • Demonstrable record in client management and working within client organizations.
  • Exceptional supervisory, organizational and communication.
  • IT literacy.
  • English first language.
